By accessing the Website, you agree that you will access the content for your personal non-commercial use only. We acknowledge our obligations under the Australian Privacy Act 1988 and related legislation. We will only use personal data collected via the Website in accordance with that Act and our Privacy Policy published on the Website

We will use our reasonable endeavours to ensure that any personal data is kept secure but due to the nature of the internet, we cannot accept any liability for those who intentionally attempt to gain unauthorised access to the Website (to the extent permitted by law).

These terms and conditions contain all of the terms and conditions relating to your use of the Website. This acknowledgement shall not apply to any misrepresentations and/or breaches of warranty which constitute fraud.

If any term or provision in these terms and conditions shall be held to be illegal or unenforceable in whole or in part such term or provision shall be deemed not to form part of these terms and conditions. The validity and enforceability of the remainder shall not be affected.

These terms and conditions shall be governed by and construed in accordance with the laws of Victoria, Australia. You hereby irrevocably agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.

 

 

Tasty Cash Program

  1. TastyCash is a prepaid stored value card program whereby the participant receives promotional credit in exchange for adding a defined amount onto their TastyCash account card. This program is accessed only by using a prepaid card bearing the word ‘TastyCash’. This program has been active in Victoria since 2010, New South Wales since 2012 and Westeran Australia since 2015.
  2. Conditions: TastyCash requires the user to prepay $50 onto their TastyCash account at a Tasty Van. Provided $50 has been prepaid, the card holder will receive a 10% discount on all Tasty Trucks products (excluding cigarettes) when the purchase is made using the TastyCash card. Membership to the Tasty Rewards Program is free. You can pick up a card from any Tasty Trucks Van and register with the Operator of that van. You can also call our head office on 1300 827 898 to have a Card mailed to your home. You can use your card at any Tasty Trucks mobile café in Victoria.
  3. How to Register your Card: If you wish to become a TastyCash member you must first register your Card with any Tasty Trucks Operator or at our website. There is a limit of one registered card per person. A registered Card is not transferable, and may only be used by the registered cardholder. It is your responsibility to keep your personal details updated.
  4. How to Cancel your Card: You may cancel your Card by telephoning our head office on 1300 827 898. If a Card is cancelled any benefits not already redeemed by the cardholder will be automatically forfeited.
  5. Lost, Stolen or Damaged Cards: Keep your card in a safe place. If your card is lost, stolen or damaged, telephone our head office on 1300 827 898. If you have registered your Card and your Card is lost or stolen, Tasty Trucks may issue you with a replacement Card. Any money loaded on your lost or stolen, registered Card will be transferred to your new Card. However, if your Card is not registered, any money loaded on that Card cannot be replaced. If your Card is damaged or unusable, Tasty Trucks may issue you with a replacement Card. If your Card is registered or if the unique barcode on the Card is still readable, any money loaded on to your damaged Card will be replaced. However, if your Card is not registered, and the unique barcode is not readable, any money already loaded on to that damaged Card cannot be replaced. The issuing of replacement Cards is at Tasty Trucks sole discretion. If an account is unused for 12 consecutive months the account will be closed and the former account holder will lose any credit that was held in the account.
  6. Tasty Trucks is not liable for: Any delay in replacing a lost, stolen or damaged Card. Any loss, theft, or damage to any documentation in the course of post or delivery of that documentation. You consent to Tasty Trucks using your personal information to operate & provide you with membership benefits of the Tasty Cash Rewards Program. You also consent to Tasty Trucks using your information to assist in planning, developing & researching product & service offerings involving Tasty Trucks. For example, we may: seek you participation (on a purely voluntary basis) in advertising campaigns, launches, customer testimonials and focus groups; and seek your feedback on the TastyCash Rewards Program and Tasty Trucks product & service offerings.
  7. Changes to Terms & Conditions Tasty Trucks reserves the right to change, suspend or terminate these Terms & Conditions, the TastyCash Rewards Program, and any benefits under the Tasty Cash Rewards Program at any time. Tasty Trucks will give advance notice of any such circumstance on our Website or you can obtain such details by calling our head office, allowing you to cancel your TastyCash membership within the period of that advance notice. Where we change the TastyCash Terms & Conditions, the TastyCash Rewards Program, or any benefits under the TastyCash Rewards program, an updated copy of them will be available on our Website or by telephoning our head office. Continuing to use your Card after the period of advance notice has expired will be deemed acceptance of the amended Terms & Conditions.

Tasty Rewards (proposed program)

1. Introduction

These terms and conditions apply to the Tasty Rewards account, (referred to as “Tasty Rewards”) and govern the relationship between Tasty Trucks, Pty Ltd trading as Tasty Fresh Food Co. (“we” or “us”) and you (“you”). Use of your Tasty Rewards account will constitute acceptance of these terms and conditions. These terms and conditions override any other statements concerning Tasty Rewards and we may update or vary these terms and conditions. You must therefore read them carefully. 2. Setting Up Your Tasty Rewards Account

You can register for Tasty Rewards by following the registration instructions on the Tasty smartphone app (Apple and Android) or online at www.Tastyfreshfoodco.com.au/Tasty-rewards. The Tasty smartphone app can be downloaded at www.Tastyfreshfoodco.com.au/Tasty-rewards or directly through the i-tunes and Google Play app stores. Your Tasty Rewards details are accessed and may be updated through the Tasty smartphone app or online at www.Tastyfreshfoodco.com.au/Tasty-rewards. It is your responsibility to keep your password secure and you must not give your password to any other person. Tasty Rewards points are obtained by making purchases at a Tasty Co store using the Tasty smartphone app. The Tasty smartphone app can be used to make purchases by linking a credit or debit card to a Tasty Rewards account by following the instructions in the smartphone app or on the website at www.Tastyfreshfoodco.com.au/my-account. It is no longer possible to credit your Tasty Rewards account at a retail outlet. Your account will maintain tokens redeemable for specified goods at a Tasty Co store. Redeemable value will accumulate to a maximum value of $100. The purpose of linking your credit or debit card to the Tasty Co. Smartphone app is to enable future provision of goods at our vans. Your Tasty Rewards account is administered by Tasty Trucks, Pty Ltd, 15 Kevin Ave, Ferntree Gully, 3156. The Tasty Rewards account may only be used to make purchases in person at participating Tasty vans and cannot be used to make remote or on-line purchases. The Tasty Rewards account is not a credit, debit or charge account.

3. Using your Tasty Rewards account

Within the Tasty Rewards feature in the app, press the ‘Account Code’ button to display your unique Tasty Rewards code. You can then display this code on your smartphone at any participating* Tasty stores. Alternatively, you can generate a payment code online at www.Tastyfreshfoodco.com.au/my-account and take that with you into the participating Tasty shop.

The code will either take the form of a 9 digit number or a QR code. The 9 digit code can be used in by a Tasty Co Sales or Customer Care representative. The QR code can be scanned using the shop’s scanners.

If you are paying using your Tasty Rewards account, when you use your Tasty Rewards code, the amount of your purchase will be deducted from the authorised account that was linked to the Tasty Rewards account in the sign up process. Any balance of points will be held for the purpose of applying to future purchases and can be viewed within the smartphone app or online at www.Tastyfreshfoodco.com.au/my-account. Please note that your balance may take up to 5 minutes to update. You can view your purchase history within the smartphone app in the Account section or online at www.Tastyfreshfoodco.com.au/Tasty-rewards.

4. Cancellation and redemption

We reserve the right to cancel your Tasty Rewards account if it has not been used for 12 consecutive months. If this occurs, any points will become invalid and any remaining funds will become our property.

We may suspend or terminate this agreement at any time by giving you reasonable prior notice.

We reserve the right to cancel your Tasty Rewards account if we suspect it is being used fraudulently or in breach of these terms and conditions.

You may terminate your Tasty Rewards account by contacting Customer Care on 1300 827 898. On receipt of this request, we will return any money you have paid into your Tasty Rewards account via your credit/debit card, unless we have reason to believe that your Tasty Rewards account has been used for fraudulent or other criminal activities or unless we are prohibited from returning the funds by any law, order, regulation or guidance from any competent authority.

Before returning funds to you, we may need to carry out checks to confirm your identity. If you do not assist us in carrying out these checks then we reserve the right to withhold payment.

5. Loss, theft, or fraudulent use

You should take care of your Tasty Rewards account and if you have funds loaded onto your account, treat it like cash. Tasty is not responsible for use of Tasty Rewards due to lost mobile phones or misuse of passwords or codes. You should immediately report any loss, theft, fraudulent or unauthorised use of your Tasty Rewards account to our Customer Care team on 1300 827 898 to enable us to place a stop on your Tasty Rewards account.

6. Resale/use in promotions

You may not sell your Tasty Rewards account or transfer the use to any third party. You must be over the age of 16 to hold a Tasty Account.

Your Tasty Rewards account may not be used in any sales or promotional activities. We reserve the right to cancel any Tasty Rewards account that we suspect has been resold, transferred or obtained in connection with an unauthorised sales or promotional activity.

8. Data Protection and Privacy

When you open a Tasty Rewards account, you will be asked to provide certain personal information, including your name, address, date of birth, gender and contact details. We are committed to maintaining the security of your personal information in accordance with the requirements of the Privacy Act and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.

We will not sell or disclose any personal data to any third party unless required to do so by law or otherwise in accordance with these terms and conditions. We will use data concerning your use of the Tasty Rewards account only for account administration purposes and for the purpose of making and administering offers to be redeemed at participating Tasty stores, for data analysis and market research. We may use other companies to operate Tasty Rewards for such tasks as processing payments, analysing data and carrying out market research. We will only disclose information to such third parties to the extent required to carry out these services.

We may send promotions, notifications or Tasty Rewards scheme information to you by email, SMS text or app push notification as part of the Tasty Rewards scheme. These pieces of communication are essential to the management and administration of Tasty Rewards and being a Tasty Rewards account holder means that you agree to this level of communication.

If you wish to see any information we hold about you or wish to request that we make changes to data that we hold then you can use the Contact Us facility at Tastyfreshfoodco.com.au or call our Customer Care team on 1300 827 898. We are entitled to charge a fee of $10 towards meeting our costs of providing you with this information.

9. Liability of Tasty Fresh Food Co.

Where any loss or damage arises through your use of your Tasty Rewards accounts from a cause within our control, our liability to you shall not exceed a sum equal to the balance on your Tasty Rewards account as at the date that such loss or damage occurs. We shall otherwise not be liable for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or loss of profit or damages) that arise from or connected with the use of the Tasty Rewards account.

Financial Compensation is not applicable to your Tasty Rewards account. We do not take part in any alternative compensation scheme.

This clause shall not exclude or limit any liability that cannot be excluded or limited by law or affect your statutory rights.

10. Variation

We reserve the right to amend or waive any provision of these terms and conditions from time to time. The terms and conditions applicable to the use of a Tasty Rewards account shall at any time be the terms and conditions published at www.tastyfreshfoodco.com.au/Tasty-rewards and your continued use of Tasty Rewards shall constitute your acceptance of such terms and conditions.

11. Governing Law

These terms and conditions are governed by the laws of the State of Victoria, Australia.

12. Sign up prize

The advertised reward for signing up is applicable only to the first time the Tasty Rewards smartphone app is used. Limit of 1 reward per person.

If a free drink, the prize can be redeemed as any drink in any size up to 600ml.

If a free sandwich or pie, the prize can be redeemed as any sandwich or pie.

Please enjoy your birthday treat within one calendar month of its issue as after this time, it will expire and no longer be available to you.

This offer has no cash value and cannot be exchanged for any other product or cash.

We reserve the right to withdraw this offer at any time.

We reserves the right to substitute any product within this promotion if the need arises.

To redeem your birthday treat, you simply need to generate a code (9 digit or QR code) through the Tasty smartphone app in the usual way or online within the Tasty Rewards pages. You can then scan or the code in a participating Tasty shop which will identify you as the Tasty Rewards account holder and the promotion will automatically be applied so that you can enjoy your birthday treat. You can then select a single serving item from our confectionary range.

14. Monthly prize draw promotion

The prize draw is open to Tasty customers who have an active Tasty Reward Account in Australia and are aged 16 or over, excluding Tasty employees, their immediate families, associates, suppliers, agents and anyone professionally connected with this promotion.

There will be prizes available every month with five winners selected in a random monthly prize draw. Each month’s prize draw will run from the first day of the month until the last day of the month.

Winners of the draw will receive points their purchase at a Tasty shop with Tasty Reward account to be used at participating Tasty stores.

Each time you make one purchase per week for 4 consecutive weeks at a participating Tasty shop through your Tasty Rewards account , you will qualify for one entry in the prize draw for the month of the purchase.

We reserve the right at our discretion to limit the maximum number of entries to five that may be made by a single Tasty Reward account for any month.

Each month five winners and two reserve winners will be selected at random from all eligible entries by an independent adjudicator appointed by us within five working days from the end of the previous month’s. The selected winners will be notified by email and / or telephone within three working days of being selected.

The prize will be automatically credited to the winners’ accounts within five working days of the draw being made.

We do not take any responsibility for entries which for technical or other reasons are not entered correctly or are lost.

There are no cash equivalent or other prize alternatives available in whole or in part except in the event of circumstances outside our the control . We reserve the right to substitute a similar alternative prize of equal or greater value in such circumstances. In the event of circumstances outside our the reasonable control, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, we reserve the right to cancel, suspend or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

We reserve the right to verify all entries and the winners and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. We will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into.

Except as otherwise required by applicable law, we accepts no responsibility or liability for lost, late, damaged, corrupted or misdirected entries or claims and we are not responsible for any late or misdirected delivery of communications (email or otherwise), except in the event of wilful intent on our part or the part of our agents.

To the fullest extent permitted by law and excluding death or personal injury caused as a result of our negligence we accept no liability for loss or injury as a result of the promotion or receipt or misuse of any prize.

Tasty Gifts

1. Introduction

These Terms and Conditions apply to Tasty Gift Cards and Tasty Staff Rewards (together referred to as Tasty Gifts) and govern the relationship between Tasty Trucks, Pty Ltd (“we” or “us”) and you or the person to whom you give the Tasty Gift to (“you”). Use of your Tasty Gift will constitute acceptance of these terms and conditions.

These terms and conditions override any statements on your Tasty Gift and we may update or vary these terms and conditions. You must therefore read them carefully. If there is anything you do not understand, please contact Customer Care on 1300 827 898

2. Purchasing your Tasty Gift

You can purchase Tasty Gifts online at www.Tastyfreshfoodco.com.au/Tasty-gifts and the Gift Cards can additionally be purchased at any participating * Tasty shop in Australia. The minimum amount required for activation is $5 and the maximum amount is $100. Your Tasty Gift is issued by, and remains the property of, Tasty Trucks, Pty Ltd.

When you buy an e-Gift or m-Gift at www. Tastyfreshfoodco.com.au/Tasty-gifts, you will be asked to give the Gift recipient’s details (email or mobile number) as well as given the opportunity to add a personal message. You will be able to select the delivery day and time for the Tasty Gift.

On receipt of your order, we will send you an order acknowledgement email to the email address which you provide in the order process. This order acknowledgement email will contain your order number, value of your Tasty Gift, your mobile number or email address that the Tasty Gift has been requested to be delivered to and a delivery date. Note that this email is only to acknowledge that your order has been received, and is not acceptance by us of any offers to purchase Tasty Gifts. We must receive full payment for the price of the Gifts before we can accept any offers. An offer made by you to purchase Gifts shall only be deemed to be accepted by us when we send you a confirmatory email to confirm that the Gift has been delivered. A purchase contract between you and us is made at the point of despatch, rather than at the point of payment. If you have cancelled your order, or if we notify you that we cannot accept your order, then no purchase contract will have been made.

We reserve the right to refuse any offers in an order prior to acceptance.

The transaction reference on your credit card statement will refer to Tasty Gifting. Third parties assist us by providing us with the e-Gift and m-Gift voucher services in order that we may issue Tasty Gifts to our customers.

If an e-Gift is delivered with a higher value than the price that was charged to the credit or debit card, we reserve the right to cancel the Tasty Gift and re-issue an e-Gift at the correct purchase price.

We are not responsible for any lost, stolen, undeliverable or delayed Tasty Gifts or any network failures. If you are the purchaser, please double check the delivery mobile phone number or email address that you enter – it is your responsibility to do so and we’re afraid we can’t be held responsible if a Tasty Gift is used by someone other than your recipient if the mobile phone number or email address entered is incorrect. In addition, we can’t take responsibility for any Tasty Gifts that are lost or used by someone other than your recipient after delivery.

3. Using your Tasty Gift Card

You may redeem your Tasty Gift Card at any participating* Tasty van in Australia. When you use your Tasty Gift Card, the amount of your purchase will be deducted from the balance on the Card. The remaining balance may be applied to future purchases. Change will not be given. You may check the balance on your Tasty Gift Card at any participating Tasty van. Your Tasty Gift Card is not a credit card, charge card or debit card. You may not exchange your Tasty Gift Card for cash. Refunds will not be given for the purchase of a Tasty Gift Card. We reserve the right to refuse to accept damaged cards or cards which we believe may have been stolen or obtained in another illegal way.

4. Registering your Tasty Gift Card

You can register your Tasty Gift Card by following the instructions at www.Tastyfreshfoodco.com.au/Tasty-gifts. Registering the card may protect its balance in the case of theft or loss.

5. Using Your Tasty e-Gift

To use a Tasty e-Gift or m-Gift, you must take your email (for e-Gifts) or mobile phone (for m-Gifts) into a participating* Tasty shop. The e-Gift and m-Gift will contain an 8 digit code that will need to be entered into the chip and pin terminal in the shop to access the gift account. We will send you an email or SMS with your updated balance in it and a reminder of your 8 digit code for next time. Please be aware that the Tasty e- Gift or m-Gift will expire if it hasn’t been used for a period of 12 consecutive months.

6. Expiration and Cancellation

Your Tasty Gift and the balance on it will expire if the card is not used for 12 consecutive months. We reserve the right to cancel your Tasty Gift if we suspect it is being used fraudulently or in breach of these Terms and Conditions.

We may suspend or terminate this agreement at any time by giving you reasonable prior notice.

7. Loss, Theft, Damage

You should take care of your Tasty Gift and treat it like cash. Tasty is not responsible for lost or stolen cards. You should immediately report any loss, theft, fraudulent or unauthorised use of your Tasty Gift Card to Customer Care on 1300 827 898

If you lose your Tasty Gift or it is stolen, damaged or malfunctions, we may, at our sole discretion, replace your Tasty Gift and transfer the balance stored on it to a replacement card or device. Circumstances in which we may determine not to replace your Tasty Gift include where we reasonably believe that the notified incident has been caused by your breach of these terms and conditions or where there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct.

In relation to your Tasty Gift Card, if you have not registered your Tasty Gift Card we will require your Tasty Gift Card number and proof of purchase before we can consider, in our sole discretion, any request to replace your Tasty Gift Card.

8. Resale/Use in Promotions

You may not sell your Tasty Gift. Tasty Gifts may not be used in sales or promotional activities including as give aways or prizes in competitions without our prior consent. We reserve the right to cancel any Tasty Gift that we suspect has been resold or obtained in connection with an unauthorised sales or promotional activity.

9. Customer Care

When you purchase your Tasty e-Gift or m-Gift or you register your Tasty Gift Card at Tastyfreshfoodco.com.au/Tasty-gifts, you will be asked to provide certain personal information, including your name, address and contact details. We are committed to maintaining the security of your personal information in accordance with the requirements of the Privacy Act and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.

We will not sell or disclose any personal data to any third party unless required to do so by law.

11. Liability of Tasty Trucks, Pty Ltd

We shall not be liable for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or loss of profit or damages) that arise from or connected with this agreement.

Where any loss or damage arises from a cause within our control, our liability to you shall not exceed a sum equal to the balance on your Gift as at the date that such loss or damage occurs.

This clause shall not exclude or limit any liability that cannot be excluded or limited by law.

12. Variation

We reserve the right to amend or waive any provision of these terms and conditions from time to time. The terms and conditions applicable to the use of a Tasty Gift shall at any time be the terms and conditions published at Tastyfreshfoodco.com.au/Tasty-gifts and your continued use of a Tasty Gift shall constitute your acceptance of such terms and conditions.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, in the Commonwealth of Australia.

14. Financial Services Compensation

In the unlikely event of the issuer of this product becoming insolvent some funds on the Tasty Gift may not be available to spend.
